According to USCIS rules, if a child is a minor, the child’s green card may be considered abandoned when the parents abandon theirs.
So, who is considered a minor child?
According to the U.S. Department of State, a child under 16 is considered a minor.
In Salar Khoshfahm v. Eric H. Holder Jr., the court ruled that the intent of a child’s parents governs the child’s status during the period before the child turns 18.
Therefore, it is safer for parents to maintain their permanent resident status until their child turns 18.
